Divorce in Thailand
 

Divorce or the dissolution of marriage is the canceling and/or reorganizing of the legal duties and responsibilities of marriage. Legal divorce in Thailand, who may get one, where and how, with an explanation of the simple divorce by mutual consent available to couples married in Thailand.

 

An uncontested divorce can be obtained at the local District Office (khet/amphur). A divorce by mutual consent must be made in writing and certified with the signature of at least two witnesses and it must be registered with the relevant authorities. The divorce documents and a summary on completing the form are available from the local District Office. All documents are in Thai.

Prenuptial Agreement

 

Thailand Prenuptial Agreements are authorized by Thai law and must conform to the Civil & Commercial Code of Thailand. The prenuptial agreement in Thailand must be signed prior to the marriage with the person who is at that time still your fiance and not yet your legal spouse. Prenuptial agreements must be registered simultaneously with the marriage in the marriage register at the local office where the marriage takes place. After the marriage the prenuptial agreement cannot be altered except by the authorisation by the Court.

Divorce

 


The family law in Thailand is fairly straightforward. Foreigners must first obtain clearance from their respective embassies. Our divorce lawyer can help co-ordinate the procurement of official documents from the embassy and have them translated and legalized quickly with minimum problems. Property in Divorce

 

Under Thai Law, properties during divorce may fall into two types. Sin Suan Tua is separate property and Sin Somros is marital property. The family law in Thailand is fairly straightforward. Foreigners must first obtain clearance from their respective embassies.

 

Sin Somros is commonly the subject of marital property division in divorce. But sometimes, even Sin Suan Tua becomes the topic of argument. A 50-50 division of the Sin Somros is the most reasonable arrangement. If the couple's investments during marriage include money or company shares, sharing becomes less difficult. However, houses and vehicles are the usual investments of couples during their marriage, and these cannot be physically split in half without altering or losing the use and value of the property. A compromise on who amongst the parties will enjoy the property has to be met in order for them to arrive at a divorce agreement. They may also opt to sell all the marital property and share the proceeds of the sale.

Child Custody

 

Child custody disputes between parents can arise in the course of a divorce case, or between unmarried parents.  Child custody cases are handled in Thailand Family courts. The main consideration used by the courts in determining custody is what is in the best interest of the child. Accordingly, the behavior of the parents and child development issues are analysed closely by the Thai court.
